These Terms & Conditions govern orders placed through the Tossed Leaf website and salad ordering system. By submitting an order, you confirm that you have read, understood, and agreed to these Terms & Conditions and the Privacy Policy.
1. Orders and acceptance
All orders are requests to purchase food and related products from Tossed Leaf. An order is accepted only when it is confirmed by us. We may reject or cancel an order before preparation for reasons including product unavailability, incorrect pricing, suspected fraud, delivery limitations, technical errors, or inability to contact the customer.
You are responsible for reviewing all selected ingredients, quantities, delivery or pickup details, contact information, and order notes before submission. Please contact us promptly if any information is incorrect. Changes are not guaranteed after preparation has started.
2. Ingredient availability and substitutions
Ingredients, recipes, portion sizes, presentation, and availability may change without notice. Photographs and illustrations are for general reference and may not exactly match the delivered product. We will not make a material substitution without reasonable notice where practical. If an ingredient is unavailable, we may contact you, remove it, offer a substitute, issue an appropriate adjustment, or cancel the affected item.
3. Allergy and dietary warning
Important: Our kitchen, preparation areas, storage areas, equipment, utensils, and delivery processes may handle common allergens, including peanuts, tree nuts, milk and dairy, eggs, wheat and gluten, soy, sesame, mustard, fish, shellfish, celery, lupin, and sulfites. Cross-contact can occur even when an allergen is not intentionally included in an item.
We do not guarantee that any item is allergen-free, gluten-free, vegan, vegetarian, halal, kosher, or suitable for a specific medical or dietary requirement unless we expressly confirm it in writing. Ingredient names and menu descriptions may not list every component of sauces, dressings, marinades, seasonings, garnishes, or processed products.
You must disclose allergies and dietary restrictions in the order notes and contact us directly before ordering so we can assess whether we can safely prepare the order. Adding a note does not guarantee that the request can be met. Customers with severe or life-threatening allergies should not place an order unless they have first received clear confirmation from us. If you experience an allergic reaction, seek emergency medical assistance immediately.
4. Food safety and customer responsibilities
Food should be consumed promptly or refrigerated as appropriate after delivery or pickup. You are responsible for proper storage, handling, reheating, and consumption after the order has been handed over. Do not consume food that appears spoiled, contaminated, damaged, or held at an unsafe temperature. Children and vulnerable persons should be supervised and food should be checked for choking hazards, bones, pits, shells, toothpicks, packaging, or other foreign materials before consumption.
5. Prices, fees, and payment
Prices, delivery fees, minimum order amounts, taxes, discounts, and promotions are shown during checkout and may change at any time before an order is submitted. The final amount shown at checkout is the amount due, subject to correction of an obvious pricing or technical error. Payment must be completed using an available payment method or as otherwise agreed.
6. Delivery and pickup
Delivery and pickup times are estimates and may be affected by traffic, weather, order volume, address accuracy, building access, security procedures, or events outside our reasonable control. You must provide a complete address, an accessible delivery location, and a working telephone number. Someone must be available to receive the order.
If delivery cannot be completed because the address is incorrect, access is unavailable, the customer does not respond, or no one is present, the order may be treated as completed and additional delivery charges may apply. Risk in the order passes to you when it is delivered, collected, or left at an agreed safe location.
7. Cancellations, refunds, and complaints
Because food is prepared to order and is perishable, cancellations and refunds are not automatic. Contact us immediately if you need to cancel or change an order. We may refuse a cancellation once preparation has started, ingredients have been committed, or a driver has been dispatched.
If an order is materially incorrect, missing, damaged, unsafe, or not delivered, contact us as soon as reasonably possible and provide the order number, details, and supporting photographs where relevant. We may offer a replacement, credit, partial refund, or full refund depending on the circumstances. Refunds are returned through the original payment method where possible and may take time to appear.
8. Promotions and discounts
Promotions may be limited by date, location, product, quantity, minimum spend, or customer eligibility. Unless stated otherwise, promotions cannot be combined, exchanged for cash, transferred, or applied retrospectively. We may withdraw or correct a promotion affected by fraud, misuse, or a technical error.
9. Website use
You must not misuse the website, interfere with its operation, submit false orders, attempt unauthorized access, introduce malicious code, scrape content, or use the service unlawfully. We may suspend access, cancel orders, or report suspected unlawful activity.
10. Intellectual property
The website, brand, logo, text, graphics, photographs, software, menu design, and other content are owned by or licensed to Tossed Leaf and may not be copied, modified, distributed, or commercially used without prior written permission.
11. Privacy
Personal information is handled as described in the Privacy Policy available in this overlay. By placing an order, you authorize us to use the information reasonably necessary to process, prepare, deliver, support, record, and communicate about the order.
12. Disclaimer and limitation of liability
Nothing in these Terms excludes liability that cannot lawfully be excluded. To the fullest extent permitted by law, Tossed Leaf is not liable for indirect, incidental, special, punitive, or consequential loss, loss of profits, loss of data, or loss arising from customer-provided information, misuse, improper storage, delayed consumption, third-party delivery services, or events beyond our reasonable control.
Where liability may lawfully be limited, our aggregate liability relating to an order will not exceed the amount paid for the affected order. This limitation does not apply to fraud, willful misconduct, or liability for death or personal injury caused by negligence where such liability cannot legally be limited.
13. Indemnity
You agree to be responsible for losses, claims, or expenses resulting from your unlawful misuse of the website, fraudulent order activity, violation of these Terms, or infringement of another person's rights.
14. Force majeure
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, road closures, power or internet outages, labor disruption, governmental action, civil disturbance, epidemic, fire, flood, supply interruption, or failure of third-party services.
15. Governing law and disputes
These Terms are governed by the laws of the Lebanese Republic, without prejudice to mandatory consumer rights that apply to you. The courts of Lebanon will have jurisdiction unless applicable law requires another forum. Before filing a formal claim, both parties should first attempt in good faith to resolve the issue by contacting each other.
16. Changes, severability, and waiver
We may update these Terms from time to time. The version displayed when an order is submitted applies to that order. If any provision is found invalid or unenforceable, the remaining provisions continue in effect. A delay in enforcing a right does not waive that right.
